Yet local governments primarily use these GAS fines to promote traffic safety, not as a revenue stream.<\/p>\n<p>This is evident from a comprehensive study by the Vias Traffic Institute and Ghent University, in which all 285 Flemish local governments were surveyed. The report does, however, recommend imposing stricter conditions on the much-discussed concession or financing model.<\/p>\n<h4>Little more than half of Flemish cities and municipalities enforce GAS system<\/h4>\n<p>Since 2021, local governments in Flanders have been able to penalize minor speeding violations on roads with a speed limit of 30 or 50 km\/h with a municipal administrative sanction (GAS fine). About 53% of Flemish cities and municipalities now enforce GAS speed limits &#8211; a sharp increase from 40% in November 2024.<\/p>\n<p>The GAS system is sometimes dismissed as a potential &#8220;cash cow,&#8221; with financial motives supposedly taking precedence over traffic safety. The study now shows that cities and municipalities primarily want to lower driving speeds and reduce traffic accidents.<\/p>\n<p>Additional revenue matters for fewer than one in four local governments. For half, it plays no significant role.<\/p>\n<h4>Fewer speeding violations<\/h4>\n<p>Notably, there is no statistically significant difference in the number of speeding violations or accidents resulting in injuries between municipalities with and without GAS speed limits, either before or after implementation. This does not mean, however, that a specific speed camera at a high-risk location is ineffective.<\/p>\n<p>Local authorities are seeing fewer speeding violations and lower driving speeds. Moreover, the effects are not necessarily limited to the areas where enforcement takes place. Road users in the wider vicinity are also adjusting their behavior.<\/p>\n<p>As a result, local governments themselves assess the impact positively: municipalities with GAS speed enforcement give an average score of 8,0 out of 10 for improved traffic safety, compared to 7,2 for municipalities without it.<\/p>\n<p>Nine out of ten local governments have also taken other measures to reduce speed since the system was introduced. For example, they are investing in traffic-calming infrastructure, establishing bicycle zones, and raising awareness among road users. Data: VVSG and the MOW Department.<\/figcaption><\/figure>\n<h4>Not automatically a purely safety-oriented tool.<\/h4>\n<p>Although the research findings support the view that local governments do not implement the GAS system primarily to generate additional revenue, they also explicitly confirm that public perception of GAS speed limits as a &#8220;cash cow&#8221; constitutes a legitimacy problem.<\/p>\n<p>For example, 57% of the boards admit that the revenues have no specific purpose and simply go into the general fund, so they are not earmarked for traffic safety. One respondent even stated literally that &#8220;the funds freed up from the GAS speed limit are used little to not at all for traffic-related measures but are considered &#8216;extra&#8217; revenue for political self-interest.&#8221;<\/p>\n<p>The authors therefore recommend reinvesting the proceeds in road safety in a more transparent manner, and more specifically in road safety, something Annick De Ridder (N-VA), the Flemish Minister of Mobility and Public Works, also advocates.<\/p>\n<p>It&#8217;s important to remember that this revenue has continued to generate record proceeds year after year. For 2026, Flanders budgets a total of 121 million euros, rising to 144 million euros in 2027.\u00a0 That is a lot of money, and as Vias points out in the study, the system is not inherently a revenue model; it is also not automatically a purely safety-oriented tool.<\/p>\n<p>In 2024, municipalities with GAS-speed received an average of \u20ac43,1 per resident in administrative penalties, compared to just \u20ac4,2 in municipalities without it.\u00a0 One extreme outlier is Lo-Reninge, which collected \u20ac441,96 per resident.<\/p>\n<p>Of every \u20ac53 fine, the municipality retains an average of \u20ac32,5 (61%); private partners receive \u20ac11 (21%). However, under the concession model (TaaS\/&#8221;Drive for Zero&#8221;), only 36% goes to the local government. And 33% of respondents consider this distribution to be skewed in favor of the private partner.<\/p>\n<h4>Stricter conditions to the concession model<\/h4>\n<p>And it is precisely that concession model &#8211; in which a private partner invests and collects a fixed fee per violation &#8211; that contains structural incentives that make the risk of being perceived as a &#8220;cash cow&#8221; a real possibility. For example, it may suggest that economic logic shaped how the road is designed, or that contract provisions prohibited municipalities from allowing traffic flow to fall below a certain threshold.<\/p>\n<p>Although VIAS states that these clauses have since been largely watered down or eliminated following intervention by the regulatory authority, it also recommends applying stricter conditions to the concession model and using objective, data-driven site selection when installing a speed camera at a specific location, precisely to avoid such misconceptions.<\/p>\n<p>Other issues highlighted by VIAS include the fact that legal entities such as leasing companies and businesses &#8211; accounting for 30 to 40% of violations &#8211; and foreign license plates lead to impunity due to time-limit issues and identification problems.<\/p>\n<p>Two parallel sanctioning systems (criminal law vs. GAS) for the same violation also result in legal inequality. Finally, police regulations are often outdated, difficult to find, and sometimes still refer to repealed rules, while the follow-up care for repeat offenders could be much better.<\/p>\n<p>The report also sets forth specific recommendations for professionalizing GAS speed through increased knowledge, improved collaboration among stakeholders, greater transparency, privacy safeguards, and systematic thematic evaluations.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Many drivers in Belgium feel like they&#8217;re being &#8220;milked&#8221; when they receive a GAS fine for a minor speeding violation in the mail.
