Ou comment la LEZ \u00e0 Bruxelles est en train de devenir un v\u00e9ritable chaos.<\/p>\n<h4>En s\u00e9curit\u00e9 jusqu'\u00e0 nouvel ordre<\/h4>\n<p>Le 1er avril, le d\u00e9lai de gr\u00e2ce de trois mois pour les v\u00e9hicules diesel Euro 5 et essence Euro 2 expirera dans la R\u00e9gion de Bruxelles-Capitale, suite \u00e0 l'annulation par la Cour constitutionnelle de l'ordonnance qui avait report\u00e9 de deux ans le renforcement de la LEZ, initialement pr\u00e9vu pour le 1er janvier 2026.<\/p>\n<p>Toutefois, le ministre bruxellois des finances et du budget, Dirk De Smedt (Anders), assure que le d\u00e9lai de gr\u00e2ce sera prolong\u00e9 et qu'aucune amende r\u00e9elle de 350 euros ne sera inflig\u00e9e tant qu'un cadre op\u00e9rationnel n'aura pas \u00e9t\u00e9 mis en place.<\/p>\n<p>Le nouveau gouvernement bruxellois dirig\u00e9 par M. Dillies travaille actuellement sur un nouveau syst\u00e8me qui r\u00e9duit l'amende \u00e0 80 euros par mois (au lieu de 350 euros par trimestre), avec une option pour un abonnement annuel.<\/p>\n<p>Ce co\u00fbt s'\u00e9l\u00e8ve \u00e0 350 euros pour les propri\u00e9taires de v\u00e9hicules diesel Euro 5 et essence Euro 2 qui n'ont pas les moyens d'acheter une nouvelle voiture, et \u00e0 200 euros pour les personnes b\u00e9n\u00e9ficiant d'une aide financi\u00e8re accrue.<\/p>\n<p>Toutefois, \u00e9tant donn\u00e9 qu'il n'existe pas encore de cadre juridique et qu'il n'y a pas de consensus au sein du gouvernement sur d'\u00e9ventuelles exemptions pour les personnes socialement d\u00e9favoris\u00e9es, il semble, d'apr\u00e8s la d\u00e9claration de M. De Smedt, que vous restiez \u00e0 l'abri de l'amende automatique de 350 euros pour l'instant, \u00e0 partir du mois d'avril.<\/p>\n<h4>Groen et Ecolo critiquent la d\u00e9cision<\/h4>\n<p>La d\u00e9cision de M. De Smedt a imm\u00e9diatement provoqu\u00e9 des remous au sein du nouveau gouvernement bruxellois. Selon la ministre bruxelloise de la Mobilit\u00e9, Elke Van den Brandt (Groen), les propos de De Smedt ne correspondent pas \u00e0 ce qui a \u00e9t\u00e9 convenu au sein du gouvernement.<\/p>\n<p>\u201cJe r\u00e9p\u00e8te une fois de plus que les Bruxellois ont besoin d'un message clair soutenu par l'ensemble du gouvernement\u201d, d\u00e9clare M. Van den Brandt. \u201cLa derni\u00e8re chose dont ils ont besoin, c'est d'une politique d'annonces qui cr\u00e9e de l'ambigu\u00eft\u00e9, de la confusion et de l'incertitude.\u201d<\/p>\n<p>Le d\u00e9put\u00e9 bruxellois et ancien ministre de la transition climatique, de l'environnement, de l'\u00e9nergie et de la sant\u00e9, Alain Maron (Ecolo), critique \u00e9galement le manque de clart\u00e9.<\/p>\n<p>Pour lui, ces atermoiements, ce manque de clart\u00e9 et ces concessions ont un impact tangible. \u201cLes enfants asthmatiques, les personnes vuln\u00e9rables et tous ceux qui vivent \u00e0 Bruxelles ou s'y rendent sont condamn\u00e9s \u00e0 respirer <a href=\"https:\/\/newmobility.news\/fr\/2026\/03\/13\/report-brussels-air-quality-stagnates-due-to-lez-postponement\/\">air malsain<\/a> pour plus longtemps encore, de subir la pollution sans pouvoir y \u00e9chapper\u201d.\u201d<\/p>\n<h4>Incertitude juridique<\/h4>\n<p>Quant \u00e0 savoir si ce report est une bonne chose d'un point de vue juridique, c'est une autre question. \u201cC'est l\u00e0 toute la difficult\u00e9\u201d, d\u00e9clare Ans Persoons (Vooruit), secr\u00e9taire d'\u00c9tat au Climat et \u00e0 l'Environnement, dans une r\u00e9action au journal Le Soir.<\/p>\n<p>Il y a le principe du statu quo, l'article 23 de la Constitution, qui interdit de r\u00e9duire \u201cde mani\u00e8re significative\u201d le niveau de protection offert par les r\u00e9glementations existantes \u201csans justification raisonnable\u201d.\u201d<\/p>\n<p>Il est fort probable que Bral, Les Chercheurs d'Air et la Ligue des droits de l'homme - le groupe qui a port\u00e9 l'affaire devant la Cour constitutionnelle l'ann\u00e9e derni\u00e8re et qui a obtenu gain de cause - intentent une nouvelle action en justice, car ils soutiennent que le fait de ne pas percevoir les amendes \u00e9quivaut \u00e0 une \u201csuspension d\u00e9guis\u00e9e\u201d de la loi, ce qu'ils consid\u00e8rent comme ill\u00e9gal.<\/p>\n<p>En outre, la situation juridique de la LEZ bruxelloise est actuellement un champ de mines dans un autre domaine. En effet, il y a \u00e9galement une violation du principe d'\u00e9galit\u00e9.<\/p>\n<p>Les avocats sp\u00e9cialis\u00e9s en droit administratif soutiennent que les citoyens qui ont engag\u00e9 des frais pour se conformer \u00e0 la loi sont d\u00e9savantag\u00e9s par rapport \u00e0 ceux pour qui les r\u00e8gles sont maintenant mises \u201cen attente\u201d.\u201d<\/p>\n<p>En tout \u00e9tat de cause, Mme Persoons souhaite que l'ordonnance soit pr\u00eate \u00e0 temps pour entrer en vigueur le 1er janvier 2027. Elle estime qu'il n'est pas possible de supprimer les amendes pour 2026, comme certains le demandent.<\/p>\n<h4>La LEZ de Bruxelles s'applique \u00e9galement aux motos<\/h4>\n<p>Enfin, le club de mobilit\u00e9 Touring souligne que la LEZ \u00e0 Bruxelles s'applique \u00e9galement aux motos, mais pas \u00e0 Anvers ni \u00e0 Gand, ce qui illustre une fois de plus l'incoh\u00e9rence de l'ensemble de la politique de la LEZ en Belgique.<\/p>\n<p>Les motos et scooters Euro 2 ne sont plus autoris\u00e9s. Touring recommande \u00e9galement \u00e0 toute personne contrainte d'acheter un mod\u00e8le plus r\u00e9cent d'opter pour une moto Euro 5, car des r\u00e9glementations plus strictes sont \u00e0 venir.<\/p>\n<p data-start=\"1668\" data-end=\"1866\">Le Touring demande \u00e9galement que les motocyclistes ne soient pas oubli\u00e9s dans le nouveau bar\u00e8me d'amendes et qu'ils puissent b\u00e9n\u00e9ficier d'un taux r\u00e9duit, \u00e9tant donn\u00e9 qu'ils contribuent moins \u00e0 la congestion par v\u00e9hicule que les voitures.<\/p>\n<p data-start=\"1871\" data-end=\"2039\">En termes d'\u00e9missions, les motocycles \u00e9mettent g\u00e9n\u00e9ralement moins de CO\u2082 par kilom\u00e8tre en raison d'une plus faible consommation de carburant et ont donc un impact moindre sur le changement climatique.<\/p>\n<p data-start=\"2044\" data-end=\"2264\">Toutefois, en ce qui concerne la qualit\u00e9 de l'air local (CO, NOx, hydrocarbures), la situation est diff\u00e9rente : les motocycles, en particulier dans le cadre de normes plus anciennes telles que Euro 2, peuvent \u00e9mettre beaucoup plus de polluants par kilom\u00e8tre que les voitures.<\/p>","protected":false},"excerpt":{"rendered":"<p>It appears that, as of April 1, you are still safe for the time being from the automatic \u20ac350 fine for drivers entering the Brussels Low-Emission Zone (LEZ) in a Euro 5 diesel or Euro 2 gasoline vehicle.
