La question qui se pose est la suivante : les robotsaxis ne sont-ils pas con\u00e7us pour se comporter dans toutes les conditions ?<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Pendant des ann\u00e9es, les voitures sans conducteur en Californie ont fonctionn\u00e9 dans une zone grise. Lorsqu'un robotaxi Waymo commet une infraction au code de la route, les agents peuvent l'arr\u00eater, et le v\u00e9hicule reconna\u00eet l'intervention. Mais, \u00e9videmment, la police n'avait personne \u00e0 qui remettre une contravention. En vertu de la l\u00e9gislation californienne en vigueur, les contraventions doivent \u00eatre d\u00e9livr\u00e9es \u00e0 une personne titulaire d'un permis de conduire qui se trouve au volant. Donc, pas de conducteur, pas d'amende.<\/p>\n<h4>Interm\u00e9diaire charg\u00e9 de l'application de la loi<\/h4>\n<p>Cette lacune est d\u00e9sormais officiellement combl\u00e9e. Les autorit\u00e9s californiennes ont sign\u00e9 une loi qui introduit un nouvel instrument juridique : l\u201c\u201davis de non-conformit\u00e9 des v\u00e9hicules autonomes\". \u00c0 partir du 1er juillet de cette ann\u00e9e, les agents en patrouille dans tout l'\u00c9tat seront autoris\u00e9s \u00e0 infliger des amendes directement au fabricant du v\u00e9hicule. Le Department of Motor Vehicles (comparable \u00e0 la DIV en Belgique) joue le r\u00f4le d'interm\u00e9diaire dans l'application de la loi.<\/p>\n<p>Le r\u00e8glement \u00e9tait attendu depuis longtemps. Mais c'est un incident en particulier qui a cristallis\u00e9 le probl\u00e8me. En 2025, un v\u00e9hicule Waymo a fait un demi-tour ill\u00e9gal \u00e0 un feu rouge \u00e0 San Bruno, juste devant deux officiers de police. Ils ont arr\u00eat\u00e9 la voiture. Ils ont jet\u00e9 un coup d'\u0153il dans le si\u00e8ge vide du conducteur. Et ils sont repartis, incapables d'agir face \u00e0 cette dangereuse infraction au code de la route.<\/p>\n<h4>Les incidents fa\u00e7onnent la loi<\/h4>\n<p>Les robotsaxis sont con\u00e7us pour ob\u00e9ir \u00e0 la loi et suivre strictement le code de la route. Mais la pratique ne correspond pas \u00e0 la th\u00e9orie du laboratoire. Surtout aux \u00c9tats-Unis o\u00f9, contrairement \u00e0 l'Europe, les routes publiques servent de terrain d'essai. \u00c0 Austin, au Texas, le National Transportation Safety Board (NTSB) a document\u00e9 au moins 24 incidents au cours desquels des v\u00e9hicules Waymo ont d\u00e9pass\u00e9 des bus scolaires \u00e0 l'arr\u00eat depuis le d\u00e9but de la derni\u00e8re ann\u00e9e scolaire. Waymo a \u00e9t\u00e9 contraint de proc\u00e9der \u00e0 un rappel de logiciel pour ces v\u00e9hicules.<\/p>\n<p>Un autre incident a suscit\u00e9 de vives critiques, cette fois de la part des pompiers : lors d'une grande panne d'\u00e9lectricit\u00e9 \u00e0 San Francisco, plusieurs Waymos ont cal\u00e9 dans des intersections actives, bloquant les interventions des services d'urgence. La nouvelle loi poussera les fabricants de robotaxis \u00e0 am\u00e9liorer la fiabilit\u00e9 du syst\u00e8me et \u00e0 accro\u00eetre leur responsabilit\u00e9. Il se peut qu'ils r\u00e9fl\u00e9chissent trop avant de lancer une nouvelle version \u00e0 la h\u00e2te.<\/p>\n<p>La plupart des cas sont examin\u00e9s par le DMV, qui d\u00e9cide alors des mesures correctives \u00e0 prendre, le cas \u00e9ch\u00e9ant. Les cons\u00e9quences peuvent \u00eatre graves. Des infractions r\u00e9p\u00e9t\u00e9es ou non r\u00e9solues peuvent entra\u00eener des restrictions d'exploitation ou une interdiction pure et simple.<\/p>\n<h4>Diff\u00e9rentes couches<\/h4>\n<p>Mais la loi est d\u00e9lib\u00e9r\u00e9ment stratifi\u00e9e. Lorsqu'un agent de police est t\u00e9moin d'une infraction mineure, comme le fait de se garer au mauvais endroit, il peut \u00e9mettre un simple avis indiquant la date, l'heure, le lieu et la plaque d'immatriculation. Si le v\u00e9hicule est impliqu\u00e9 dans une collision et qu'il est responsable, un repr\u00e9sentant du fabricant re\u00e7oit directement la contravention. Dans tous les autres cas, l'agent signale l'incident au DMV et au constructeur dans les 72 heures (24 heures pour les infractions plus graves).<\/p>\n<p>Les constructeurs doivent \u00e9galement mettre \u00e0 jour chaque ann\u00e9e un \u201cplan d'interaction avec les premiers intervenants\u201d. Il s'agit d'un document accessible au public expliquant comment les forces de l'ordre peuvent interagir avec le v\u00e9hicule. Il leur donne \u00e9galement acc\u00e8s aux documents d'immatriculation et d'assurance et leur permet de joindre un op\u00e9rateur \u00e0 distance dans les 30 secondes. Les \u00e9quipes d'urgence peuvent \u00e9galement acc\u00e9der \u00e0 une fonction de commandement permettant de d\u00e9gager les v\u00e9hicules bloqu\u00e9s. Le DMV californien qualifie ce paquet de \u201cr\u00e9glementation AV la plus compl\u00e8te du pays\u201d.\u201d<\/p>\n<p>En outre, la nouvelle loi ne se limite pas \u00e0 des amendes. Elle impose \u00e9galement des essais pr\u00e9alables beaucoup plus rigoureux, jusqu'\u00e0 500 000 miles en fonction de la classe de poids du v\u00e9hicule, avec des essais supervis\u00e9s et des essais sans conducteur. Elle ouvre \u00e9galement le march\u00e9 californien aux v\u00e9hicules autonomes de transport de marchandises lourdes pesant plus de 4,54 tonnes, qui \u00e9taient auparavant interdits dans l'\u00c9tat.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h4>Le contraste europ\u00e9en<\/h4>\n<p>Alors que la Californie s'empresse de mettre en place un cadre d'application pour les robotsaxis d\u00e9j\u00e0 en activit\u00e9, l'Europe est encore en train de construire la piste d'atterrissage qui leur est destin\u00e9e. Le cadre actuel de l'UE reste limit\u00e9 aux v\u00e9hicules de petite s\u00e9rie. Ceux-ci ne sont autoris\u00e9s qu'\u00e0 l'int\u00e9rieur de limites g\u00e9ographiques d\u00e9finies, et une supervision humaine continue reste obligatoire. Des autorisations plus larges sont toutefois en cours d'\u00e9laboration. \u00c0 ce titre, l'approche californienne constitue une \u00e9tape r\u00e9glementaire importante.
