\u00c0 compter du 1er juillet 2026, de nombreuses amendes routi\u00e8res en Belgique augmenteront de 10%. Le gouvernement De Wever a annonc\u00e9 cette mesure \u00e0 la fin de l'ann\u00e9e derni\u00e8re<\/a> dans le cadre de ses efforts visant \u00e0 g\u00e9n\u00e9rer des recettes budg\u00e9taires suppl\u00e9mentaires. La date d'entr\u00e9e en vigueur a d\u00e9sormais \u00e9t\u00e9 fix\u00e9e.<\/p>\n

Cette augmentation concerne les amendes \u00e0 paiement imm\u00e9diat : les sanctions standard inflig\u00e9es pour de nombreuses infractions courantes sans passage devant le tribunal. Elle concernera les conducteurs pris en flagrant d\u00e9lit d'exc\u00e8s de vitesse, de non-port de la ceinture de s\u00e9curit\u00e9, d'utilisation d'un t\u00e9l\u00e9phone portable au volant ou de conduite en \u00e9tat d'ivresse.<\/p>\n

L'impact est \u00e9vident \u00e0 la lumi\u00e8re de quelques exemples tir\u00e9s du quotidien. Une infraction mineure pour exc\u00e8s de vitesse, qui co\u00fbte actuellement environ 68 \u20ac, passera \u00e0 environ 74 \u20ac. Le non-port de la ceinture de s\u00e9curit\u00e9 passera de 126 \u20ac \u00e0 138 \u20ac. L'utilisation d'un t\u00e9l\u00e9phone portable \u00e0 la main au volant, une infraction de troisi\u00e8me degr\u00e9, passera de 182 \u20ac \u00e0 201 \u20ac.<\/p>\n

Les sanctions en cas de conduite en \u00e9tat d'ivresse sont \u00e9galement alourdies, m\u00eame si leur montant total d\u00e9pend du taux d'alcool\u00e9mie constat\u00e9 et de la sanction inflig\u00e9e. Dans les cas graves, l'amende ne constitue qu'une partie des cons\u00e9quences.<\/p>\n

L'augmentation des amendes permettra-t-elle de rendre les routes plus s\u00fbres ?<\/h4>\n

C'est l\u00e0 la question centrale. Les experts en s\u00e9curit\u00e9 routi\u00e8re doutent qu'une augmentation relativement modeste du montant de l'amende puisse modifier de mani\u00e8re significative le comportement des conducteurs.<\/p>\n

Selon Stef Willems, porte-parole de l'institut de s\u00e9curit\u00e9 routi\u00e8re Vias, le risque de se faire prendre constitue un facteur dissuasif bien plus fort que le montant de l'amende. Un radar, un contr\u00f4le de police visible ou un contr\u00f4le routier cibl\u00e9 sont donc plus susceptibles d'influencer les comportements qu'une l\u00e9g\u00e8re augmentation du montant de l'amende.<\/p>\n

Cela ne signifie pas pour autant que les amendes n'ont aucun r\u00f4le \u00e0 jouer. Mais leur impact sur la s\u00e9curit\u00e9 d\u00e9pend de ce qui se passe autour d'elles. Les recettes issues des amendes peuvent contribuer \u00e0 am\u00e9liorer l'application de la loi, les campagnes de sensibilisation et les infrastructures routi\u00e8res. Des contr\u00f4les cibl\u00e9s aux carrefours, aux abords des \u00e9coles, aux passages pi\u00e9tons et dans d'autres lieux o\u00f9 les usagers vuln\u00e9rables de la route sont expos\u00e9s \u00e0 un risque accru peuvent faire une diff\u00e9rence tangible.<\/p>\n

Le retrait du permis a des cons\u00e9quences plus importantes<\/h4>\n

Pour certaines infractions, les sanctions vont d\u00e9j\u00e0 au-del\u00e0 d'une simple amende. Depuis f\u00e9vrier, l'utilisation d'un t\u00e9l\u00e9phone portable \u00e0 la main au volant peut entra\u00eener un retrait imm\u00e9diat du permis de conduire pendant 15 jours. En cas de conduite en \u00e9tat d'ivresse, un taux d'alcool\u00e9mie \u00e9gal ou sup\u00e9rieur \u00e0 0,8 g\/l peut \u00e9galement entra\u00eener un retrait imm\u00e9diat du permis de conduire pendant 15 jours.<\/p>\n

Ces mesures peuvent avoir un impact plus fort qu\u2019une amende plus \u00e9lev\u00e9e, car elles perturbent directement la vie quotidienne. La perte du permis de conduire a des r\u00e9percussions sur le travail, les responsabilit\u00e9s familiales et la mobilit\u00e9, ce qui n\u2019est souvent pas le cas d\u2019une amende suppl\u00e9mentaire de 10 ou 20 \u20ac.<\/p>\n

\u201c Une vache \u00e0 lait \u201d pour l'\u00c9tat ?<\/h4>\n

Les associations d'automobilistes soutiennent depuis longtemps que les amendes routi\u00e8res servent trop souvent \u00e0 renflouer les caisses de l'\u00c9tat plut\u00f4t qu'\u00e0 am\u00e9liorer la s\u00e9curit\u00e9 routi\u00e8re. Leurs critiques risquent de s'intensifier d\u00e9sormais que cette hausse est explicitement li\u00e9e aux besoins budg\u00e9taires.<\/p>\n

Le v\u00e9ritable test consistera \u00e0 voir si le gouvernement accompagnera l'augmentation des amendes d'une meilleure application de la loi et d'une conception des routes plus s\u00fbre. Les d\u00e9tracteurs font valoir que les contr\u00f4les devraient se concentrer l\u00e0 o\u00f9 se croisent des flux de circulation dangereux et o\u00f9 les pi\u00e9tons et les cyclistes sont les plus expos\u00e9s \u2014 et non pas simplement dans des zones \u00e0 faible risque o\u00f9 les amendes sont faciles \u00e0 percevoir.<\/p>\n

Des amendes plus \u00e9lev\u00e9es pourraient g\u00e9n\u00e9rer davantage de recettes.
