Le proc\u00e8s climatique intent\u00e9 par l'agriculteur bio belge Hugues Falys contre TotalEnergies devrait-il \u00e0 nouveau \u00eatre transf\u00e9r\u00e9 de Mons \u00e0 Tournai ? Si cela ne tenait qu'au g\u00e9ant p\u00e9trolier fran\u00e7ais, ce serait le cas, puisque TotalEnergies a d\u00e9pos\u00e9 une requ\u00eate en ce sens.<\/p>\n

Quoi qu\u2019il en soit, il s\u2019agit d\u2019une man\u0153uvre proc\u00e9durale remarquable et, selon les ONG qui soutiennent Hugues Falys, TotalEnergies recourt d\u00e9lib\u00e9r\u00e9ment \u00e0 des man\u0153uvres dilatoires. Un tribunal sp\u00e9cialis\u00e9 dans les questions environnementales doit d\u00e9sormais se prononcer sur la demande de TotalEnergies.<\/p>\n

Enchev\u00eatrement juridique<\/h4>\n

Pour ceux qui ont du mal \u00e0 d\u00e9m\u00ealer les fils de cette affaire li\u00e9e au climat, celle-ci a \u00e9t\u00e9 port\u00e9e devant le tribunal de commerce de Tournai en 2024. En mars de cette ann\u00e9e<\/a>, le tribunal a d\u00e9clar\u00e9 l'affaire recevable mais ne s'est pas encore prononc\u00e9 sur le fond ; cette d\u00e9cision a \u00e9t\u00e9 suspendue dans l'attente de l'issue d'une affaire similaire \u00e0 Paris.<\/p>\n

En juin, TotalEnergies a toutefois interjet\u00e9 appel de cette d\u00e9cision. L'affaire a donc \u00e9t\u00e9 renvoy\u00e9e devant la Cour d'appel de Mons, o\u00f9 la proc\u00e9dure devait, en principe, repartir de z\u00e9ro.<\/p>\n

TotalEnergies fait d\u00e9sormais valoir devant la Cour d\u2019appel de Mons qu\u2019elle a perdu un \u201c niveau de comp\u00e9tence \u201d. Il est donc demand\u00e9, \u00e0 titre de mesure provisoire, que l\u2019affaire soit renvoy\u00e9e devant le tribunal de premi\u00e8re instance de Tournai avant qu\u2019un nouvel appel ne soit interjet\u00e9 devant la Cour d\u2019appel de Mons.<\/p>\n

Quelle est la raison de cette demande ? Le tribunal de Tournai s'est prononc\u00e9 uniquement sur la recevabilit\u00e9 de la demande de dommages-int\u00e9r\u00eats et des mesures demand\u00e9es dans le cadre de l'affaire, et non sur le fond.<\/p>\n

Cela constituerait une violation du principe du \u201c double jugement \u201d, c'est-\u00e0-dire le droit \u00e0 ce qu'une affaire soit examin\u00e9e par deux juges successifs, \u00e0 savoir d'abord par un juge de premi\u00e8re instance, puis, si l'une des parties s'y oppose, par un juge d'appel.<\/p>\n

La Cour d'appel de Mons va d\u00e9sormais commencer par fixer un nouveau calendrier pour les plaidoiries relatives \u00e0 la mesure provisoire demand\u00e9e. Ce n'est qu'une fois que la Cour aura d\u00e9cid\u00e9 du lieu des audiences que les plaidoiries concernant la recevabilit\u00e9 et le fond de l'affaire reprendront.<\/p>\n

Man\u0153uvre dilatoire<\/h4>\n

Selon les ONG qui soutiennent Hugues Falys, TotalEnergies recourt d\u00e9lib\u00e9r\u00e9ment \u00e0 une tactique dilatoire. \u201c C\u2019est une strat\u00e9gie que la multinationale a d\u00e9j\u00e0 utilis\u00e9e dans d\u2019autres affaires li\u00e9es au climat, comme \u00e0 Paris (\u2026). \u00bb.<\/p>\n
