La F\u00e9d\u00e9ration des entreprises de Belgique (FEB), principale organisation patronale du pays, met en garde contre le fait que la date butoir du 1er janvier 2027 pour la mise en place obligatoire du budget de mobilit\u00e9 n'est plus tenable. Les entreprises ne disposent toujours pas du cadre juridique d\u00e9finitif n\u00e9cessaire pour pr\u00e9parer et mettre en \u0153uvre cette r\u00e9forme.<\/p>\n

Le ministre f\u00e9d\u00e9ral du Travail, David Clarinval (MR), serait d\u00e9sormais dispos\u00e9 \u00e0 envisager un report, selon les journaux \u00e9conomiques L\u2019Echo\/De Tijd.<\/p>\n

Ce n'est pas la premi\u00e8re fois qu'une r\u00e9forme du budget de la mobilit\u00e9 ne respecte pas son \u00e9ch\u00e9ance. Les textes l\u00e9gislatifs n'\u00e9tant pas pr\u00eats \u00e0 la date initialement pr\u00e9vue du 1er janvier 2026, l'entr\u00e9e en vigueur de cette mesure avait d\u00e9j\u00e0 \u00e9t\u00e9 report\u00e9e une premi\u00e8re fois au 1er janvier 2027.<\/p>\n

Une obligation plut\u00f4t qu'un libre choix<\/h4>\n

Dans le cadre de cette r\u00e9forme, le budget mobilit\u00e9 ne rel\u00e8verait plus de la discr\u00e9tion de l'employeur, mais deviendrait obligatoire. Les employeurs qui mettent des v\u00e9hicules de fonction \u00e0 la disposition de leurs salari\u00e9s depuis plus de 36 mois et qui comptent au moins 50 salari\u00e9s devront d\u00e9sormais proposer un budget mobilit\u00e9 \u00e0 leurs salari\u00e9s.<\/p>\n

Les petites entreprises comptant au moins 15 salari\u00e9s sont pour l'instant exempt\u00e9es, mais devront se conformer \u00e0 cette obligation \u00e0 compter du 1er janvier 2028. Les entreprises en difficult\u00e9, telles que celles proc\u00e9dant \u00e0 des licenciements collectifs, sont exempt\u00e9es de cette obligation.<\/p>\n

Les salari\u00e9s restent par ailleurs enti\u00e8rement libres de choisir s'ils souhaitent opter pour le budget mobilit\u00e9. Il sera \u00e9galement possible de laisser les contrats de location en cours arriver \u00e0 \u00e9ch\u00e9ance avant de revendre le v\u00e9hicule.<\/p>\n

La moiti\u00e9 du budget consacr\u00e9 \u00e0 la mobilit\u00e9 est affect\u00e9e aux frais de logement<\/h4>\n

Le budget mobilit\u00e9 est en vigueur depuis 2019. Les salari\u00e9s disposant d'une voiture de fonction peuvent l'\u00e9changer contre des solutions de mobilit\u00e9 plus durables et mieux adapt\u00e9es \u00e0 leurs besoins.<\/p>\n

Ils peuvent utiliser ce budget, qui b\u00e9n\u00e9ficie \u00e9galement d'avantages fiscaux, pour acheter une voiture \u00e9cologique moins ch\u00e8re ou d'autres solutions de mobilit\u00e9 durable, comme un v\u00e9lo ou un abonnement aux transports en commun. Toute personne disposant d'un solde budg\u00e9taire r\u00e9siduel peut demander \u00e0 ce qu'il lui soit vers\u00e9, ce qui constitue l'option la moins avantageuse sur le plan fiscal.<\/p>\n

Toute personne qui rend sa voiture de fonction et qui habite dans un rayon de 10 kilom\u00e8tres autour de son lieu de travail, ou qui travaille \u00e0 domicile au moins la moiti\u00e9 du temps, peut \u00e9galement utiliser son budget mobilit\u00e9 pour payer son cr\u00e9dit immobilier ou son loyer. C'est de loin le utilisation la plus courante<\/a> du budget consacr\u00e9 \u00e0 la mobilit\u00e9.<\/p>\n

\u2018 Des ajustements sont n\u00e9cessaires \u2019<\/h4>\n

Mais un nouveau report semble probable car, comme le souligne la FEB, aucun texte officiel n'a \u00e9t\u00e9 publi\u00e9 \u00e0 ce jour, et les entreprises ne peuvent pas mettre en \u0153uvre une telle r\u00e8gle sans en conna\u00eetre pr\u00e9cis\u00e9ment les implications, afin de pouvoir adapter leurs processus administratifs et leurs proc\u00e9dures internes.<\/p>\n

La FEB appelle \u00e9galement une nouvelle fois au respect de la recommandation unanime du Conseil central des affaires \u00e9conomiques (CRB) et du Conseil national du travail (NAR).<\/p>\n

Ils pr\u00f4nent une simplification administrative et, surtout, la fixation d'un plafond de 50% pour le budget de mobilit\u00e9 consacr\u00e9 aux frais de logement, notamment parce que ne pas le faire risquerait de faire grimper les prix de l'immobilier.<\/p>\n

Selon les calculs du cabinet de conseil EY, le projet belge visant \u00e0 rendre obligatoire le budget f\u00e9d\u00e9ral de mobilit\u00e9 pour les employeurs proposant des voitures de fonction pourrait \u00e9galement avoir un impact un d\u00e9ficit pouvant atteindre 1 milliard d'euros<\/a> par an de recettes f\u00e9d\u00e9rales. Il semble donc opportun que la f\u00e9d\u00e9ration bancaire Febelfin et la Banque nationale formulent une recommandation concernant l'impact budg\u00e9taire.<\/p>\n

Lors d'une audition devant une commission parlementaire, le ministre de l'Emploi, David Clarinval, a reconnu que plusieurs points essentiels restaient en suspens.
