\u00c0 partir de l'ann\u00e9e prochaine, plusieurs amendes routi\u00e8res augmenteront aux Pays-Bas. Cette hausse r\u00e9sulte d'un projet de d\u00e9cision du Conseil des ministres relative \u00e0 l'indexation, qui pr\u00e9voit une augmentation des amendes de 2,71 TP3T, avec effet au 1er janvier 2027.<\/p>\n

En cons\u00e9quence, l'amende pour utilisation d'un t\u00e9l\u00e9phone portable \u00e0 v\u00e9lo passera de 170 \u20ac \u00e0 180 \u20ac, et celle pour conduite d'un v\u00e9lo tout en conduisant un v\u00e9hicule \u00e0 moteur passera de 120 \u20ac \u00e0 130 \u20ac. En Belgique, ces deux infractions sont passibles d'une amende identique de 174 \u20ac.<\/p>\n

Au total, 9 des 16 amendes les plus courantes inflig\u00e9es aux cyclistes aux Pays-Bas augmenteront en moyenne de 4,31 TP3T.<\/p>\n

Si tu as moins de 16 ans, tu paies la moiti\u00e9 du prix<\/h4>\n

Parmi les autres amendes inflig\u00e9es aux cyclistes dont le montant augmentera de 10 \u20ac, on peut citer le d\u00e9passement non conforme, le blocage d'un carrefour et le fait d'entraver le passage des usagers des transports en commun lors de leur mont\u00e9e ou de leur descente. Ces infractions seront toutes sanctionn\u00e9es d'une amende de 130 \u20ac.<\/p>\n

Rouler \u00e0 v\u00e9lo sans feux et avec des freins d\u00e9fectueux co\u00fbtera \u00e9galement plus cher, les amendes passant dans les deux cas de 75 \u00e0 80 euros.<\/p>\n

Un \u00e9clairage inadapt\u00e9 ou d\u00e9fectueux, par exemple un feu de couleur incorrecte ou mal fix\u00e9, est \u00e9galement passible d'une amende de 80 \u20ac. Les feux de v\u00e9lo clignotants ou \u00e9blouissants sont \u00e9galement passibles d'une amende de 80 \u20ac. Les feux de v\u00e9lo amovibles ou \u00e0 clipser sont autoris\u00e9s, \u00e0 condition qu'ils soient solidement fix\u00e9s et visibles.<\/p>\n

Toute personne circulant \u00e0 v\u00e9lo \u00e0 contresens devra s'acquitter d'une amende de 80 \u20ac au lieu de 75 \u20ac. Cette mesure s'applique \u00e9galement \u00e0 toute personne qui n'emprunte pas la piste cyclable lorsque cela est obligatoire. Circuler \u00e0 v\u00e9lo en \u00e9tat d'ivresse ou sur l'autoroute reste passible de la m\u00eame amende, soit 200 \u20ac. Une sonnette de v\u00e9lo cass\u00e9e est passible d'une amende de 50 \u20ac.<\/p>\n

Pour les jeunes de moins de 16 ans, les amendes sont g\u00e9n\u00e9ralement r\u00e9duites de moiti\u00e9. En 2027, ils devront s'acquitter d'une amende de 90 \u20ac s'ils tiennent, par exemple, leur t\u00e9l\u00e9phone en main lorsqu'ils font du v\u00e9lo.<\/p>\n

Les amendes doivent \u00eatre proportionn\u00e9es \u00e0 la gravit\u00e9 des faits<\/h4>\n

\u201c Outre le risque de se voir infliger une amende plus \u00e9lev\u00e9e, les situations dangereuses sont plus susceptibles d'entra\u00eener des accidents \u201d, explique Nick Brendel, expert en assurance chez Overstappen.nl, le site de comparaison qui a dress\u00e9 une liste des amendes routi\u00e8res destin\u00e9es aux cyclistes et dont le montant est sur le point d'augmenter.<\/p>\n

\u201c Surtout avec des v\u00e9los co\u00fbteux comme les v\u00e9los \u00e9lectriques, les d\u00e9g\u00e2ts mat\u00e9riels caus\u00e9s par un accident peuvent s'av\u00e9rer tr\u00e8s on\u00e9reux. Une assurance v\u00e9lo peut couvrir une partie de ces frais, mais c'est bien s\u00fbr en adoptant un comportement prudent sur la route que l'on \u00e9vite la plupart des probl\u00e8mes. \u201d<\/p>\n

Aux Pays-Bas, certaines critiques portent sur le rapport entre le montant des amendes et la gravit\u00e9 de l'infraction. Par exemple, griller un feu rouge \u00e0 v\u00e9lo est souvent plus dangereux que de jeter un bref coup d'\u0153il \u00e0 son t\u00e9l\u00e9phone sur une route peu fr\u00e9quent\u00e9e, mais l'amende est moins \u00e9lev\u00e9e.<\/p>\n

L'Association n\u00e9erlandaise des cyclistes (ANWB) estime que les amendes doivent \u00eatre proportionnelles \u00e0 la gravit\u00e9 de l'infraction et contribuer \u00e0 la s\u00e9curit\u00e9 routi\u00e8re.<\/p>\n

Le minist\u00e8re public avait d\u00e9j\u00e0 signal\u00e9 que ces montants n'\u00e9taient plus \u00e0 la hauteur de ceux pr\u00e9vus pour des infractions plus graves. L'amende inflig\u00e9e pour l'utilisation d'un t\u00e9l\u00e9phone portable a \u00e9t\u00e9 d\u00e9lib\u00e9r\u00e9ment maintenue \u00e0 un niveau \u00e9lev\u00e9 afin de dissuader ce type de comportement, notamment \u00e0 v\u00e9lo.
