{"id":183547,"date":"2026-03-30T12:15:09","date_gmt":"2026-03-30T10:15:09","guid":{"rendered":"https:\/\/newmobility.news\/?p=183547"},"modified":"2026-04-03T08:27:38","modified_gmt":"2026-04-03T06:27:38","slug":"brussels-lez-pause-on-fines-for-euro-5-diesel-and-euro-2-gasoline-vehicles-remains-in-effect","status":"publish","type":"post","link":"https:\/\/newmobility.news\/nl\/2026\/03\/30\/brussels-lez-pause-on-fines-for-euro-5-diesel-and-euro-2-gasoline-vehicles-remains-in-effect\/","title":{"rendered":"Nog steeds geen LEZ boetes in Brussel: wat chauffeurs moeten weten van 1 april"},"content":{"rendered":"<p>Het lijkt erop dat je vanaf 1 april voorlopig nog gevrijwaard blijft van de automatische boete van \u20ac350 voor bestuurders die de Brusselse lage-emissiezone (LEZ) binnenrijden in een Euro 5-diesel of Euro 2-benzinevoertuig.<\/p>\n<p>Hoewel je voertuig officieel verboden is, worden er geen boetes uitgeschreven voor de voertuigen in kwestie zolang er geen operationeel kader is. Of hoe de LEZ in Brussel echt verandert in een chaotische puinhoop.<\/p>\n<h4>Veilig tot nader order<\/h4>\n<p>Op 1 april zal de drie maanden respijtperiode voor Euro 5 diesel en Euro 2 benzine voertuigen vervallen in het Brussels Hoofdstedelijk Gewest, na de vernietiging door het Grondwettelijk Hof van de verordening die de aanscherping van de LEZ had uitgesteld met twee jaar, oorspronkelijk gepland voor 1 januari 2026.<\/p>\n<p>De Brusselse minister van Financi\u00ebn en Begroting, Dirk De Smedt (Anders), verzekert echter dat de aflossingsvrije periode zal worden verlengd en dat er geen boete van 350 euro zal worden opgelegd zolang er geen operationeel kader is.<\/p>\n<p>De nieuwe Brusselse regering onder Dillies werkt momenteel aan een nieuw systeem dat de boete verlaagt naar \u20ac80 per maand (in plaats van \u20ac350 per kwartaal), met een optie voor een jaarabonnement.<\/p>\n<p>Dit kost 350 euro voor eigenaars van Euro 5-dieselvoertuigen en Euro 2-benzinevoertuigen die zich geen nieuwe auto kunnen veroorloven, en een gereduceerd tarief van 200 euro voor mensen die meer financi\u00eble steun ontvangen.<\/p>\n<p>Maar aangezien er nog geen wettelijk kader is en er geen consensus is binnen de overheid over mogelijke vrijstellingen voor sociaal zwakkeren, lijkt het erop dat je, op basis van de verklaring van De Smedt, voorlopig, vanaf april, gevrijwaard blijft van de automatische boete van 350 euro.<\/p>\n<h4>Groen en Ecolo bekritiseren het besluit<\/h4>\n<p>De beslissing van De Smedt heeft meteen voor opschudding gezorgd binnen de nieuwe Brusselse regering. Volgens Brussels minister van Mobiliteit Elke Van den Brandt (Groen) strookt wat De Smedt zegt niet met wat binnen de regering was afgesproken.<\/p>\n<p>\u201cIk herhaal nogmaals dat de Brusselaars nu een duidelijke boodschap nodig hebben die door de hele regering wordt gesteund,\u201d zegt Van den Brandt. \u201cHet laatste wat ze nodig hebben is meer aankondigingspolitiek die dubbelzinnigheid, verwarring en onzekerheid cre\u00ebert.\u201d<\/p>\n<p>Ook Brussels parlementslid en voormalig minister van Klimaatverandering, Milieu, Energie en Gezondheid Alain Maron (Ecolo) bekritiseert het gebrek aan duidelijkheid.<\/p>\n<p>Voor hem hebben dit uitstel, deze onduidelijkheid en deze concessies een tastbare impact. \u201cKinderen met astma, kwetsbare personen en iedereen die in Brussel woont of Brussel bezoekt, zijn veroordeeld tot het inademen van <a href=\"https:\/\/newmobility.news\/nl\/2026\/03\/13\/report-brussels-air-quality-stagnates-due-to-lez-postponement\/\">ongezonde lucht<\/a> nog langer te lijden onder vervuiling zonder er aan te kunnen ontsnappen.\u201d<\/p>\n<h4>Juridische onzekerheid<\/h4>\n<p>Of het uitstel juridisch gezien een goede zaak is, is een andere vraag. \u201cDat is de hele moeilijkheid,\u201d zegt Ans Persoons (Vooruit), staatssecretaris voor Klimaat en Milieu, in een reactie aan de krant Le Soir.<\/p>\n<p>Er is het standstill-beginsel, artikel 23 van de grondwet, dat verbiedt het beschermingsniveau dat door bestaande regelgeving wordt geboden \u201caanzienlijk\u201d te verlagen \u201czonder redelijke rechtvaardiging\u201d.\u201d<\/p>\n<p>De kans is groot dat Bral, Les Chercheurs d'Air en de Liga voor Mensenrechten - de groep die de zaak vorig jaar aanhangig maakte bij het Grondwettelijk Hof en won - nog een rechtszaak zullen aanspannen, omdat zij aanvoeren dat het niet innen van boetes neerkomt op een \u201cverkapte opschorting\u201d van de wet, die zij illegaal achten.<\/p>\n<p>Bovendien is de juridische situatie rond de Brusselse LEZ momenteel een mijnenveld op nog een ander gebied. Er is immers ook sprake van een schending van het gelijkheidsbeginsel.<\/p>\n<p>Advocaten die gespecialiseerd zijn in administratief recht stellen dat burgers die kosten hebben gemaakt om aan de wet te voldoen, benadeeld worden ten opzichte van degenen voor wie de regels nu \u201con hold\u201d worden gezet.\u201d<\/p>\n<p>Persoons wil in ieder geval dat de verordening op tijd klaar is om op 1 januari 2027 in werking te treden. Ze denkt dat het niet mogelijk is om de boetes voor 2026 af te schaffen, zoals sommigen vragen.<\/p>\n<h4>Brussel LEZ geldt ook voor motorfietsen<\/h4>\n<p>Ten slotte wijst de mobiliteitsclub Touring erop dat de LEZ in Brussel ook van toepassing is op motorfietsen, maar niet in Antwerpen of Gent, wat nog een voorbeeld is van hoe inconsistent het hele LEZ-beleid in Belgi\u00eb is.<\/p>\n<p>Euro 2-motorfietsen en -scooters zijn niet langer toegestaan. Touring raadt iedereen die een nieuwer model moet kopen ook aan om voor een Euro 5-motorfiets te kiezen, omdat er binnenkort strengere regels komen.<\/p>\n<p data-start=\"1668\" data-end=\"1866\">Touring dringt er ook op aan dat motorrijders niet over het hoofd worden gezien in het nieuwe boetestelsel en dat ze in aanmerking komen voor een gereduceerd tarief, aangezien ze per voertuig minder bijdragen aan files dan auto's.<\/p>\n<p data-start=\"1871\" data-end=\"2039\">Wat uitstoot betreft, stoten motorfietsen over het algemeen minder CO\u2082 per kilometer uit door een lager brandstofverbruik en hebben ze daardoor een kleinere impact op de klimaatverandering.<\/p>\n<p data-start=\"2044\" data-end=\"2264\">Als het gaat om lokale luchtkwaliteit (CO, NOx, koolwaterstoffen) is de situatie echter anders: motorfietsen kunnen, vooral onder oudere normen zoals Euro 2, aanzienlijk meer vervuilende stoffen per kilometer uitstoten dan auto's.<\/p>","protected":false},"excerpt":{"rendered":"<p>It appears that, as of April 1, you are still safe for the time being from the automatic \u20ac350 fine for drivers entering the Brussels Low-Emission Zone (LEZ) in a Euro 5 diesel or Euro 2 gasoline vehicle.
