{"id":185906,"date":"2026-05-07T09:31:35","date_gmt":"2026-05-07T07:31:35","guid":{"rendered":"https:\/\/newmobility.news\/?p=185906"},"modified":"2026-05-07T09:31:35","modified_gmt":"2026-05-07T07:31:35","slug":"no-driver-no-excuse-robotaxis-no-longer-escape-fines","status":"publish","type":"post","link":"https:\/\/newmobility.news\/nl\/2026\/05\/07\/no-driver-no-excuse-robotaxis-no-longer-escape-fines\/","title":{"rendered":"Geen chauffeur, geen excuus: robotaxi's ontsnappen niet langer aan boetes"},"content":{"rendered":"<p>Californi\u00eb dicht een jarenlange maas in de wet die ervoor zorgde dat bestuurderloze auto's in feite onaantastbaar waren voor de verkeerspolitie. Vanaf deze zomer kunnen fabrikanten van autonome voertuigen direct worden beboet voor verkeersovertredingen die hun voertuigen begaan. De vraag is: zijn robotauto's niet gebouwd om zich onder alle omstandigheden te gedragen?<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Jarenlang opereerden bestuurderloze auto's in Californi\u00eb in een grijze zone. Wanneer een Waymo robotaxi een verkeersovertreding begaat, kunnen agenten hem aan de kant zetten en het voertuig herkent de ingreep. Maar de politie had natuurlijk niemand om een bekeuring aan te geven. Onder de bestaande Californische wet moesten verkeersovertredingen worden uitgeschreven aan een mens met een rijbewijs achter het stuur. Dus, geen bestuurder, geen boete.<\/p>\n<h4>Handhaving tussenpersoon<\/h4>\n<p>Die kloof wordt nu formeel gedicht. Ambtenaren van Californi\u00eb hebben een wet ondertekend die een nieuw juridisch instrument introduceert: de \u201ckennisgeving van niet-naleving van de voorschriften voor autonome voertuigen\u201d. Vanaf 1 juli van dit jaar mogen patrouillerende agenten in de hele staat boetes rechtstreeks uitschrijven aan de fabrikant van het voertuig. Het Department of Motor Vehicles (vergelijkbaar met de DIV in Belgi\u00eb) treedt op als tussenpersoon voor de handhaving.<\/p>\n<p>De verordening zat er al lang aan te komen. Maar het was \u00e9\u00e9n incident in het bijzonder dat het probleem kristalliseerde. In 2025 maakte een Waymo-voertuig een illegale U-bocht bij een verkeerslicht in San Bruno, recht voor de ogen van twee politieagenten. Ze hielden de auto aan de kant. Ze gluurden in de lege bestuurdersstoel. En ze reden weg, niet in staat om iets te doen aan de gevaarlijke verkeersovertreding.<\/p>\n<h4>Incidenten vormen de wet<\/h4>\n<p>Robotaxi's zijn ontworpen om de wet te gehoorzamen en de verkeersregels strikt op te volgen. Maar de praktijk komt niet overeen met de laboratoriumtheorie. Vooral in de VS, waar, in tegenstelling tot Europa, de openbare weg fungeert als proeftuin. In Austin, Texas, heeft de National Transportation Safety Board (NTSB) minstens 24 incidenten gedocumenteerd waarbij Waymo-voertuigen stilstaande schoolbussen passeerden sinds het begin van het recente schooljaar. Waymo werd gedwongen om een software recall uit te vaardigen voor die voertuigen.<\/p>\n<p>Een ander incident leverde scherpe kritiek op, dit keer van brandweerfunctionarissen: tijdens een grote stroomstoring in San Francisco bleven meerdere Waymos stilstaan op actieve kruispunten, waardoor hulpdiensten werden geblokkeerd. De nieuwe wet zal fabrikanten van robotaxi's onder druk zetten om de betrouwbaarheid van het systeem te verbeteren en hun aansprakelijkheid te vergroten. Ze zullen misschien nog eens goed nadenken voordat ze overhaast een nieuwe versie lanceren.<\/p>\n<p>De meeste gevallen worden beoordeeld door de DMV, die vervolgens beslist welke maatregelen eventueel nodig zijn. De gevolgen kunnen ernstig zijn. Herhaalde of onopgeloste overtredingen kunnen escaleren tot exploitatiebeperkingen of een volledig rijverbod.<\/p>\n<h4>Verschillende lagen<\/h4>\n<p>Maar de wet is opzettelijk gelaagd. Wanneer een politieagent getuige is van een kleine overtreding, zoals parkeren op de verkeerde plaats, kan hij een eenvoudige bekeuring uitschrijven met vermelding van de datum, tijd, locatie en het kenteken. Als het voertuig betrokken is bij een aanrijding en de schuldige is, ontvangt een vertegenwoordiger van de fabrikant direct de bekeuring. In alle andere gevallen rapporteert de agent het incident aan zowel de DMV als de fabrikant binnen 72 uur (24 uur voor ernstigere overtredingen).<\/p>\n<p>Fabrikanten moeten ook een jaarlijks bijgewerkt \u201cFirst Responder Interaction Plan\u201d bijhouden. Dit is een openbaar document waarin wordt uitgelegd hoe wetshandhavers met het voertuig kunnen communiceren. Het geeft hen ook toegang tot registratie- en verzekeringsdocumenten en stelt hen in staat om binnen 30 seconden een operator op afstand te bereiken. Noodhulpdiensten hebben nu ook toegang tot een commandofunctie die geblokkeerde voertuigen kan verwijderen. De California DMV noemt dit pakket \u201cde meest uitgebreide AV-regelgeving in het land\u201d.\u201d<\/p>\n<p>Bovendien gaat de nieuwe wet niet alleen over boetes. De wet schrijft ook aanzienlijk strengere voorafgaande tests voor, tot 500.000 mijl afhankelijk van de gewichtsklasse van het voertuig, met zowel gecontroleerde als volledig bestuurderloze testritten. De wet stelt de Californische markt ook open voor autonome zware vrachtvoertuigen met een gewicht van meer dan 4,54 ton, die voorheen verboden waren in de staat.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h4>Het Europese contrast<\/h4>\n<p>Terwijl Californi\u00eb zich haast om een handhavingskader op te zetten voor robotaxi's die al actief zijn, is Europa nog bezig met de aanleg van de landingsbaan voor deze voertuigen. Het huidige EU-kader blijft beperkt tot voertuigen uit kleine series. Deze zijn alleen toegestaan binnen bepaalde geografische grenzen, terwijl continu menselijk toezicht verplicht blijft. Bredere goedkeuringen zijn echter in de maak. Als zodanig is de Californische aanpak een mijlpaal op het gebied van regelgeving.
