Nieuw boetebeleid De Lijn doet wenkbrauwen fronsen"},"content":{"rendered":"<p>Elke buschauffeur in dienst van de Vlaamse openbare vervoersmaatschappij De Lijn krijgt jaarlijks drie kleine verkeersovertredingen vergoed. Vanaf de vierde lichte overtreding binnen 12 maanden moet de chauffeur de boete zelf betalen. Ernstigere overtredingen, zoals rijden onder invloed, zijn vanaf het begin de verantwoordelijkheid van de werknemer.<\/p>\n<p>De nieuwe regeling geldt voor heel Vlaanderen. Hiermee rekent De Lijn af met de soms grote en onlogische provinciale verschillen in de afhandeling van verkeersboetes die in de loop der tijd zijn ontstaan.<\/p>\n<h4>Weg met het oude systeem<\/h4>\n<p>In 2023 - de meest recente cijfers die beschikbaar zijn - werden 2.532 overtredingen vastgesteld bij chauffeurs van De Lijn, goed voor een recordbedrag van meer dan 173.000 euro. Afhankelijk van de provincie waar ze reden, betaalden buschauffeurs in het oude systeem echter een hoger of lager persoonlijk aandeel van een verkeersboete na een overtreding.<\/p>\n<p>Zo betaalden Limburgse bestuurders in 2024 bijna de helft van de boetes zelf, terwijl dat in Antwerpen slechts 13,5% was, terwijl De Lijn gemiddeld al bijna driekwart van de boetes voor haar rekening nam.<\/p>\n<p>In de praktijk is het nieuwe systeem voor verkeersboetes dus niet echt nieuw - behalve dat het afwijkt van het oude systeem en rekening houdt met de aard en het aantal overtredingen gedurende 12 maanden.<\/p>\n<h4>Ernstige overtredingen zijn altijd de verantwoordelijkheid van de bestuurder<\/h4>\n<p>De buschauffeur hoeft alleen uit eigen zak te betalen voor de vierde kleine overtreding - zoals een snelheidsovertreding van 10 km\/u of minder - binnen 12 maanden.<\/p>\n<p>De Lijn dekt ook een enkele overtreding van meer dan 10 km\/u, maar alleen op voorwaarde dat de bestuurder geen tweede overtreding begaat in dezelfde categorie binnen de volgende 12 maanden. Anders moet de bestuurder zowel de eerste als de tweede boete volledig betalen.<\/p>\n<p>Ernstige overtredingen, zoals rijden onder invloed van alcohol of drugs, of boetes voor het gebruik van een mobiele telefoon tijdens het rijden, vallen altijd 100% onder de verantwoordelijkheid van de werknemer.<\/p>\n<h4>Vias is sceptisch<\/h4>\n<p>Volgens minister van Mobiliteit Annick De Ridder (N-VA) moet het nieuwe systeem de \u201ctoerekenbaarheid\u201d bevorderen. \u201cWie dagelijks verantwoordelijk is voor het veilig vervoer van duizenden passagiers, draagt immers ook een grote verantwoordelijkheid op de weg. Verkeersveiligheid moet altijd op de eerste plaats komen - voor chauffeurs, passagiers en alle andere weggebruikers.\u201d<\/p>\n<p>In een reactie op de nieuwssite van de VRT toonde het verkeersinstituut Vias zich echter sceptisch over de nieuwe regeling. \u201cDe job van een buschauffeur is niet gemakkelijk, maar vanuit het oogpunt van verkeersveiligheid is het altijd beter dat degene die de overtreding begaat de boete betaalt,\u201d zei woordvoerder Stef Willems.<\/p>\n<h4>Gevestigd<\/h4>\n<p>Terugbetaling van verkeersboetes door werkgevers bij openbaarvervoermaatschappijen is geen universele praktijk, maar sommige maatschappijen - zowel in Belgi\u00eb als in het buitenland - bieden inderdaad een gedeeltelijke terugbetaling.<\/p>\n<p>Artikel 67 van de Wegenverkeerswet bepaalt immers dat de werkgever civielrechtelijk aansprakelijk is voor de boetes en gerechtskosten die de werknemer tijdens het rijden maakt voor overtredingen die hij begaat tijdens de uitoefening van zijn werk. De werknemer blijft strafrechtelijk aansprakelijk en de werkgever heeft het recht om het boetebedrag op de werknemer te verhalen.<\/p>\n<p>Waar De Lijn wel in uitblinkt - het bedrijf moet bovenop de boete ook nog de solidariteitsbijdrage 33% betalen omdat de betaling van de boete door de werkgever fiscaal als loon wordt beschouwd - is dat ze naar het publiek communiceert dat dit een systeem is van \u201cdrie kleine overtredingen per jaar\u201d.\u201d<\/p>\n<p>Een dergelijk beleid lijkt inderdaad te impliceren dat kleine snelheidsovertredingen \u201cgratis\u201d zijn. Tegelijkertijd ondermijnt het de persoonlijke verantwoordelijkheid van chauffeurs, ook al is de redenering dat buschauffeurs vaak onder tijdsdruk van strakke schema's werken.<\/p>\n<p>Bij recidivisten zou echter ook een analyse van de rijtijden en -schema's moeten worden uitgevoerd om kleine overtredingen structureel te voorkomen.
