Brussel was ooit een van de eerste Europese steden waar het delen van e-scooters een enorme vlucht nam. Op het hoogtepunt \u2013 tot grote ergernis van degenen die jaloers waren \u2013 waren er in de hele stad meer dan 20.000 e-scooters beschikbaar die iedereen kon pakken.<\/p>\n

Maar nu is het plezier voorbij, en daarmee ook dat sprookje over micromobiliteit \u2013 hoewel sommigen het liever een nachtmerrie zouden noemen. Naar aanleiding van een uitspraak van de Raad van State heeft Brussels Mobility besloten dat de verschillende Brusselse exploitanten hun gedeelde e-scooters en fietsen uiterlijk op 1 september uit de openbare ruimte moeten verwijderen \u2013 een overgangsperiode van amper een maand.<\/p>\n

De leemte die is ontstaan door het verdwijnen van deelde-scooters en -fietsen in Brussel is aanzienlijk: in 2025 waren deelde-scooters en -fietsen goed voor 14,5 miljoen ritten en 1,3 miljoen actieve gebruikersaccounts.<\/p>\n

In strijd met de wet en onrechtmatig<\/h4>\n

Het besluit van Brussels Mobility staat los van een ander, eerder besluit. In juni besloot de nieuwe Brusselse regering, onder leiding van Bors Dilli\u00e8s, om een verbod op het delen van e-scooters<\/a> in het Brussels Hoofdstedelijk Gewest, met ingang van 1 januari 2027.<\/p>\n

Het was, op zijn zachtst gezegd, een twijfelachtige beslissing, genomen onder het mom van diverse veiligheidsoverwegingen, zeker gezien tegen de achtergrond van het strengere regelgevingskader dat in samenwerking met de exploitanten was ontwikkeld.<\/p>\n

Ruim zes weken later worden diezelfde exploitanten opnieuw geconfronteerd met een ernstige tegenslag. Op woensdag 29 juli heeft de Raad van State de vergunningen vernietigd die aan Bolt, Dott en Von waren verleend voor het delen van e-scooters en e-fietsen in Brussel.<\/p>\n

Dit was een reactie op een klacht die was ingediend door het Amerikaanse platform Lime, dat in 2023 buiten de selectie viel toen de regio besloot het aantal exploitanten te beperken.<\/p>\n

De Raad van State oordeelde onder meer dat de wet die een expliciete motivering van bestuursbesluiten voorschrijft, was geschonden. Bovendien zijn deze besluiten gebaseerd op een oproep tot het indienen van kandidaturen, die op zijn beurt weer is gebaseerd op een besluit uit 2023 \u201cwaarvan verschillende bepalingen op zichzelf onwettig zijn\u201d.\u201d<\/p>\n

De regio heeft verzocht om handhaving van de huidige vergunningen, maar dat verzoek is afgewezen.<\/p>\n

Overlegbijeenkomst met exploitanten<\/h4>\n

De Raad van State heeft ook afgezien van een uitspraak over toekomstige maatregelen. De uitspraak heeft evenmin gevolgen voor de Villo!-dienst, die fietsen aanbiedt op vaste stations. De huidige concessie, die wordt beheerd door JC Decaux, loopt in september af.<\/p>\n

De Brusselse regering heeft al besloten om de regeling te verlengen tot september 2028. Hierdoor kunnen de Brusselaars blijven gebruikmaken van een fietsdeeldienst in afwachting van een nieuw systeem, dat ook vaste stations zal omvatten.<\/p>\n

Half augustus organiseert Brussels Mobility nu een overlegbijeenkomst met Bolt, Dott, Voi en Lime om de uitspraak te bespreken en mogelijke volgende stappen te verkennen. Er bestaat een kans dat er v\u00f3\u00f3r 1 september een nieuwe, tijdelijke of herziene regeling komt, maar dat is niet zeker.<\/p>\n

Brussels Mobility heeft ook een offici\u00eble brief gestuurd naar de betrokken exploitanten, waarin het hen verzoekt de voertuigen waarop de ingetrokken vergunningen betrekking hebben, van de straat te halen.<\/p>\n

Vanwege het zomerseizoen voert de regio een \u2018overgangsperiode\u2019 in, zodat exploitanten de uitdienstneming van hun wagenparken uiterlijk op 1 september 2026 kunnen regelen.<\/p>\n

Voor de exploitanten is dit ongetwijfeld een zware financi\u00eble klap. Ze moeten op korte termijn hun volledige vloot uit de roulatie halen, wat volgens de leveranciers hoge kosten met zich meebrengt (en banenverlies\u2026). Daardoor kunnen nieuwe rechtszaken niet worden uitgesloten.<\/p>\n

Petitie<\/h4>\n

De vraag blijft dan ook wat veel forenzen en (jonge) Brusselaars die bijna dagelijks gebruikmaken van gedeelde e-scooters en fietsen, vanaf 1 september zullen moeten doen om bijvoorbeeld de laatste paar kilometer naar hun werk af te leggen.<\/p>\n

Het lijdt geen twijfel dat deelde-scooters en -fietsen populair zijn. Volgens Way To Go, een Belgisch netwerk dat gedeelde mobiliteit promoot, waren deelde-fietsen en -scooters in Brussel in 2025 goed voor in totaal 14,5 miljoen ritten en 1,3 miljoen actieve gebruikersaccounts.<\/p>\n

Dat jaar telde Brussel 10.738 deelfietsen en 7.221 deel-e-scooters, waarmee de stad het hoogste gebruik per inwoner in Belgi\u00eb had.<\/p>\n

En er zijn inderdaad Villo!-deelfietsen, maar dat systeem is verouderd, en wie gebruik wil maken van elektrische ondersteuning, moet naast een maandelijks abonnement eerst een persoonlijke, draagbare accu huren.<\/p>\n

Way To Go is bijvoorbeeld van mening dat de gevolgen van een probleem met de vergunningsprocedure niet mogen worden afgewenteld op mensen die dagelijks op deze vervoerswijzen vertrouwen, met name voor de eerste of laatste kilometer of \u2019s avonds wanneer het openbaar vervoer ontoereikend is.<\/p>\n

Dott roept gebruikers op om een petitie op Democratie.Brussels te ondertekenen; als er 1.000 handtekeningen worden verzameld, moet het Brussels Parlement zich over deze kwestie buigen. Vandaag stond de teller op 1.047.<\/p>","protected":false},"excerpt":{"rendered":"
