Moet de klimaatzaak die de Belgische biologische boer Hugues Falys tegen TotalEnergies heeft aangespannen, opnieuw worden verplaatst van Mons naar Doornik? Als het aan de Franse oliegigant lag, zou dat inderdaad gebeuren, aangezien TotalEnergies een verzoek daartoe heeft ingediend.<\/p>\n

Het is in ieder geval een opmerkelijke procedurele zet, en volgens de ngo\u2019s die Hugues Falys steunen, past TotalEnergies opzettelijk vertragingstactieken toe. Een gespecialiseerde milieurechtbank moet zich nu uitspreken over het verzoek van TotalEnergies.<\/p>\n

Juridische wirwar<\/h4>\n

Voor wie moeite heeft om de draad van deze klimaatzaak te volgen: de zaak begon in 2024 bij de Handelsrechtbank van Doornik. In maart van dit jaar<\/a>, verklaarde de rechtbank de zaak ontvankelijk, maar deed nog geen uitspraak ten gronde \u2013 die uitspraak werd opgeschort in afwachting van de uitkomst van een soortgelijke zaak in Parijs.<\/p>\n

In juni heeft TotalEnergies echter beroep aangetekend tegen die uitspraak. Daardoor werd de zaak doorverwezen naar het Hof van Beroep in Mons, waar de procedure in principe helemaal opnieuw zou beginnen.<\/p>\n

TotalEnergies voert nu voor het Hof van Beroep van Mons aan dat het een \u201cbevoegdheidsniveau\u201d heeft verloren. Daarom wordt als voorlopige maatregel verzocht de zaak terug te verwijzen naar de rechtbank van eerste aanleg in Doornik, alvorens er een nieuw beroep wordt ingesteld bij het Hof van Beroep van Mons.<\/p>\n

Wat is de reden voor dit verzoek? De rechtbank van Doornik heeft zich uitsluitend uitgesproken over de ontvankelijkheid van de schadeclaim en de gevraagde maatregelen in de zaak, en niet over de grond van de zaak.<\/p>\n

Dit zou in strijd zijn met het beginsel van de \u201cdubbele rechtsbehandeling\u201d, het recht om een zaak door twee opeenvolgende rechters te laten behandelen, namelijk eerst door een rechter in eerste aanleg en vervolgens, indien een partij het daar niet mee eens is, door een rechter in hoger beroep.<\/p>\n

Het Hof van Beroep van Mons zal nu eerst een nieuw tijdschema vaststellen voor de pleidooien met betrekking tot de gevraagde voorlopige maatregel. Pas nadat het hof een besluit heeft genomen over de locatie van de zittingen, zullen de pleidooien over de ontvankelijkheid en de grond van de zaak worden hervat.<\/p>\n

Uitstelmanoeuvre<\/h4>\n

Volgens de ngo\u2019s die Hugues Falys steunen, hanteert TotalEnergies opzettelijk een vertragingstactiek. \u201cDit is een strategie die de multinational eerder heeft toegepast in andere klimaatzaken, zoals in Parijs (\u2026).<\/p>\n
