De Federatie van Ondernemingen in Belgi\u00eb (FEB), de belangrijkste werkgeversorganisatie van het land, waarschuwt dat de deadline van 1 januari 2027 voor het verplichte mobiliteitsbudget niet langer haalbaar is. Bedrijven beschikken nog steeds niet over het definitieve wettelijke kader dat nodig is om de hervorming voor te bereiden en door te voeren.<\/p>\n

Volgens de zakelijke kranten L\u2019Echo\/De Tijd zou federaal minister van Arbeid David Clarinval (MR) nu openstaan voor uitstel.<\/p>\n

Dit is niet de eerste keer dat de hervorming van het mobiliteitsbudget de deadline niet heeft gehaald. Omdat de wetsteksten niet op tijd klaar waren voor de oorspronkelijke deadline van 1 januari 2026, was de inwerkingtreding al eenmaal uitgesteld tot 1 januari 2027.<\/p>\n

Verplichting in plaats van vrije keuze<\/h4>\n

In het kader van de hervorming zou het mobiliteitsbudget niet langer ter beoordeling van de werkgever staan, maar verplicht worden. Werkgevers die al langer dan 36 maanden bedrijfswagens ter beschikking stellen en ten minste 50 werknemers in dienst hebben, moeten hun werknemers voortaan een mobiliteitsbudget aanbieden.<\/p>\n

Kleine bedrijven met ten minste 15 werknemers zijn voorlopig vrijgesteld, maar zullen naar verwachting vanaf 1 januari 2028 aan deze verplichting moeten voldoen. Bedrijven die in moeilijkheden verkeren, zoals bedrijven die te maken hebben met grootschalige ontslagen, zijn vrijgesteld van deze verplichting.<\/p>\n

Werknemers blijven bovendien volledig vrij om te kiezen of ze al dan niet voor het mobiliteitsbudget willen kiezen. Het is ook mogelijk dat lopende leasecontracten gewoon aflopen voordat het voertuig wordt ingeruild.<\/p>\n

De helft van het mobiliteitsbudget voor woonlasten<\/h4>\n

Het mobiliteitsbudget is sinds 2019 van kracht. Medewerkers met een bedrijfswagen kunnen deze inruilen voor duurzamere mobiliteitsoplossingen die beter aansluiten bij hun behoeften.<\/p>\n

Ze kunnen dit eveneens fiscaal voordelige budget gebruiken om een goedkopere, milieuvriendelijke auto aan te schaffen of andere duurzame mobiliteitsoplossingen, zoals een fiets of een abonnement voor het openbaar vervoer. Wie nog een saldo over heeft, kan dit laten uitbetalen; dit is de minst fiscaal voordelige optie.<\/p>\n

Iedereen die zijn bedrijfsauto inruilt en binnen een straal van 10 kilometer van zijn werkplek woont, of minstens de helft van de tijd vanuit huis werkt, kan zijn mobiliteitsbudget ook gebruiken om zijn hypotheek of huur te betalen. Dit is veruit de meest voorkomende toepassing<\/a> van het mobiliteitsbudget.<\/p>\n

\u2018Er zijn aanpassingen nodig\u2019<\/h4>\n

Maar een verdere vertraging lijkt waarschijnlijk, omdat \u2013 zoals de FEB aangeeft \u2013 er tot op heden nog geen offici\u00eble tekst is gepubliceerd en bedrijven een dergelijke regel niet kunnen invoeren zonder precies te weten wat deze inhoudt, zodat ze hun administratieve processen en interne procedures daarop kunnen afstemmen.<\/p>\n

De FEB dringt er ook opnieuw op aan dat de unanieme aanbeveling van de Centrale Raad voor de Economie (CRB) en de Nationale Arbeidsraad (NAR) wordt gerespecteerd.<\/p>\n

Zij pleiten voor administratieve vereenvoudiging en vooral voor een 50%-plafond op het mobiliteitsbudget voor woonlasten, mede omdat het achterwege laten daarvan de vastgoedprijzen zou kunnen opdrijven.<\/p>\n

Volgens berekeningen van adviesbureau EY zou het Belgische plan om het federale mobiliteitsbudget verplicht te stellen voor werkgevers die bedrijfswagens aanbieden, ook een tekort van maximaal 1 miljard euro<\/a> per jaar aan federale inkomsten. Daarom lijkt het raadzaam dat de bankenfederatie Febelfin en de Nationale Bank een aanbeveling doen over de gevolgen voor de begroting.<\/p>\n

Tijdens een hoorzitting van een parlementaire commissie gaf minister van Werkgelegenheid David Clarinval toe dat een aantal essenti\u00eble punten nog steeds niet is opgelost.
